These Terms & Conditions (“Terms”) govern your use of reliablenapa.com (the “Site”), operated by Reliable Refrigeration, doing business as “Reliable Heating and Air” and “Reliable” (“Reliable,” “we,” “us,” or “our”). By using the Site, you agree to these Terms, including the binding arbitration and class-action waiver in Section 9. If you do not agree, do not use the Site.
These Terms cover your use of the website only. Any heating, cooling, or refrigeration work we perform is governed by a separate written estimate or service agreement and by California contractor law — not by these Terms.
1. Use of the Site
We grant you a limited, personal, non-exclusive, non-transferable license to view and use the Site for your own informational, non-commercial purposes. You agree not to: use the Site unlawfully or in a way that could damage or impair it; copy, scrape, or republish Site content without permission; attempt unauthorized access to the Site or its systems; or submit false, misleading, or another person’s information through our forms.
2. Quotes, estimates, and pricing
Site content — including service descriptions and any sample pricing or promotions — is general information and is not a binding offer. Firm pricing is provided only in a written quote after we assess your specific property. Promotions are subject to their stated terms and expiration dates and may change or end at any time. A signed written estimate or agreement controls over the Site.
3. Requests submitted through the Site
Submitting a form (quote, contact, or job application) does not create a service contract or employment relationship; it is a request we will respond to. See our Privacy Policy for how we handle it.
4. Intellectual property
The Site and its content — text, graphics, logos, the “Reliable Heating and Air” name and marks, and layout — are owned by or licensed to Reliable and protected by law. Do not use our name, logo, or marks without prior written permission.
5. Third-party links and content
The Site may link to third-party websites and services. We do not control and are not responsible for their content, products, or practices.
6. Disclaimers
The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, or that information on it is complete, current, or accurate. General HVAC information on the Site is educational and is not a substitute for an in-person assessment by a qualified technician.
7. Limitation of liability
To the fullest extent permitted by law, Reliable and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of data, use, or goodwill, arising out of or relating to your use of the Site. Nothing in these Terms limits your rights or remedies regarding services we actually perform, which are governed by your written agreement with us and by California law.
8. Indemnification
You agree to indemnify and hold Reliable harmless from claims and expenses arising out of your misuse of the Site or violation of these Terms.
9. Binding arbitration; class-action waiver
Please read this section carefully — it affects how disputes are resolved.
Any dispute or claim arising out of or relating to the Site or these Terms will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration will take place in Napa County, California, or by videoconference, and these Terms are governed by the laws of the State of California without regard to conflict-of-laws rules.
Class-action waiver. Disputes will be arbitrated only on an individual basis; you and Reliable waive any right to bring or participate in a class, collective, or representative action.
Consistent with the AAA Consumer Arbitration Rules, Reliable will pay the arbitration filing and administration fees for consumer claims to the extent those rules require. Your right to opt out: you may opt out of this arbitration agreement by emailing hello@reliablenapa.com with “Arbitration Opt-Out” in the subject line within 30 days of first accepting these Terms; opting out will not affect any other part of these Terms.
This Section 9 does not apply to the separate written service agreement for any work we perform, which contains its own dispute-resolution terms and preserves your rights under California contractor law.
10. Changes
We may update these Terms; the updated version will be posted here with a new date, and continued use of the Site means you accept the changes.
